4) Acceptable Use

You agree not to:

Post false, misleading, fraudulent, or inaccurate listings (including fake prices, photos, or locations).
Post content that is illegal, abusive, discriminatory, hateful, or harassing.
Upload viruses, malware, or attempt to disrupt the site.

Scrape, copy, or harvest user data (phone numbers, emails, listings) without permission.

Use the site to spam, send unsolicited promotions, or run scams.
Circumvent any security features or access restricted areas.

We may remove content or suspend accounts that violate these Terms.

5) Listings and Classified Ads Rules

When posting a listing, you confirm that:

You have the legal right and permission to advertise the property/product/service.
The listing is truthful and not misleading.
Photos and descriptions are owned by you or used with proper permission.
You will keep your listing updated (availability, pricing, contact details).
You will respond responsibly and professionally to inquiries.

We do not guarantee that any listing will receive inquiries, leads, or result in a sale/rental.

6) Verification, Moderation, and Removal

We may review, approve, reject, edit, or remove listings or accounts to maintain quality and safety.
We may request documents or proof (ownership, agency license, authorization) to verify a listing or user.
We can limit or remove features for accounts that repeatedly violate policies or receive credible complaints.

7) User Communications and Safety

Any communication between users is at their own risk.
Do not share sensitive information publicly (IDs, bank details, full private documents).
Always confirm details in person and use safe payment practices.
We are not responsible for disputes, fraud, or losses resulting from user interactions.

8) Fees, Packages, and Payments

If Blue Nile Homes offers paid services (e.g., memberships, featured listings, paid submissions):

Prices and package details will be displayed before purchase.
Payments are processed using our available payment methods.
If you purchase a package, it applies to the account that purchased it unless stated otherwise.
Refunds policy: Digital listing services may be non-refundable once activated/used. Please refer to our refund policy on our website under refund policy section.

9) Intellectual Property
Blue Nile Homes, including its brand, logo, design, and software, is owned by us or our licensors and protected by applicable laws.
You may not copy, modify, distribute, or reverse-engineer any part of the site without written permission.

10) Your Content License to Us

When you upload or post content (listing text, photos, etc.), you keep ownership of your content, but you grant Blue Nile Homes a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it for operating and promoting the site (including marketing, social media previews, and search features), until you remove it or your account is terminated (subject to backups/caching). You confirm you have the rights to grant this license.

11) Privacy

Our collection and use of personal data is described in our Privacy Policy. By registering, you consent to our data practices, including contacting you about account activity, listings, or important service updates.

12) Disclaimer

Blue Nile Homes provides an online platform for listings and classifieds. We do not guarantee accuracy of listings, verify every user or property, or provide legal, financial, or real estate advice. Users are responsible for due diligence, inspections, contracts, and compliance with applicable laws.

13) Limitation of Liability

To the maximum extent permitted by law:

Blue Nile Homes is not liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim related to the site is limited to the amount you paid to us in the amount the subscription fee or amount of listing fee you used (or 0 if you paid nothing), whichever is greater, unless prohibited by law.

14) Indemnity

You agree to defend, indemnify, and hold harmless Blue Nile Homes and its owners, employees, and partners from claims, losses, liabilities, and expenses (including legal fees) arising from your content, your use of the site, your violation of these Terms, or your interactions or transactions with other users.

15) Termination and Suspension

We may suspend or terminate your account at any time if you violate these Terms, post prohibited content, we suspect fraud or harm to users, or as required by law. You may stop using the site anytime. If your account is terminated, your listings may be removed.

16) Changes to the Site and Terms

We may update the site, features, pricing, or these Terms from time to time. We will post updates on the website and update the effective date. Continued use after updates means you accept the revised Terms.

17) Governing Law and Disputes

These Terms are governed by the laws of country of your jurisdiction. Disputes should first be attempted to be resolved informally by contacting us at support@bluenilehomes.com. If unresolved, disputes may be handled in the courts of your jurisdiction, unless local law requires otherwise.
